Draft document, pending legal review

This document is a working draft prepared as part of building FriendlySpeaking. It is not legal advice and has not yet been approved by Canadian or United States legal counsel. Final wording will be confirmed by qualified counsel before launch.

1. Acceptance

By creating an account or using FriendlySpeaking, you agree to these Terms of Use, our Privacy Policy, the Parent and Guardian Agreement, and our Community Guidelines. If you do not agree, please do not use the service.

2. Eligibility

You must be at least 18 years old to create or operate an account. Children and teens cannot create or operate accounts independently, and there is no sign-in pathway for them.

3. Parent and guardian representation

You confirm that you are an adult and that you are the parent or legal guardian of the child or children whose information you provide, or that you are otherwise legally authorized to provide that information.

4. Your account

  • Provide accurate information and keep it current.
  • Keep your password confidential and do not share your account.
  • Tell us promptly if you believe your account has been accessed without permission.
  • You are responsible for activity that happens through your account.

5. Child information

We ask for the minimum information needed to suggest a possible friendship opportunity: a first name or nickname, an age range, interests and activities, languages, general availability, and an approximate area. We do not ask for a child's home address, school address, phone number, email address, or social media accounts.

6. Privacy and consent

Our handling of personal information is described in the Privacy Policy and the Children's Privacy Notice for Parents. Where parental consent is required by law, a child profile does not become active until the required consent has been recorded.

7. Matching and compatibility

Compatibility scores are estimates based on the preferences provided by parents. They are not guarantees of friendship, safety, or suitability. Matching suggestions are for friendship and activity discovery only and are never used to make decisions about schooling, healthcare, finances, employment, legal status, or benefits.

8. Introductions and messaging

Messaging happens only between adult account holders. An introduction request never opens a conversation on its own: the other parent may accept, decline, wait, or block. Children cannot send or receive messages, accept invitations, or exchange contact information.

9. Activities and venues

Activity and venue information may come from third parties and may change. Parents should verify location, time, age requirements, cost, availability, safety conditions, accessibility, and cancellation policies directly.

10. User content and photos

You are responsible for the content you upload and you confirm that you have the right to share it. Photos of children are private or limited in visibility by default and are not used for advertising, public galleries, promotional material, facial recognition, or AI training.

11. Prohibited conduct

  • Misrepresenting yourself, your family, or your relationship to a child.
  • Requesting private information about another family's child.
  • Contacting or attempting to contact another family's child directly.
  • Harassment, threats, sexual content, grooming behaviour, or exploitation of any kind.
  • Sharing another family's details without their permission.
  • Scraping, automated collection, or reuse of profile information.
  • Using the service for advertising, recruitment, or commercial solicitation.
  • Ignoring a block or attempting to evade suspension.

12. Safety, reporting and blocking

Every profile and conversation includes report and block options. Reports involving possible child endangerment receive elevated priority and are reviewed by authorized safety personnel. FriendlySpeaking does not perform background checks, criminal screening, child-abuse registry screening, or sex-offender screening. Verification badges indicate only what they say, such as an email or phone number being verified, and are not an endorsement of anyone's character.

13. Suspension and termination

We may warn, restrict, suspend, or permanently remove accounts that break these terms or create a safety risk. You may delete your account, or an individual child profile, at any time from the Privacy Center.

14. Intellectual property

FriendlySpeaking and its content, branding, and software are owned by us or our licensors. You keep ownership of the content you provide and grant us the limited permission needed to operate the service.

15. Third-party services

The service may link to or rely on third-party providers. We are not responsible for third-party content, terms, or practices.

16. Disclaimers

FriendlySpeaking helps parents discover possible friendship and activity opportunities. It does not replace parental judgment, supervision, or responsibility, and it is not a safety guarantee. The service is provided on an as-is basis to the extent permitted by applicable law.

17. Limitation of liability, indemnity and disputes

Provisions covering limitation of liability, indemnification, governing law, dispute resolution, arbitration, and class actions are reserved and will be completed after review by qualified counsel in each relevant Canadian and United States jurisdiction. Nothing in this draft limits rights that cannot be limited under applicable consumer-protection law.

18. Changes to these terms

We will post updates here with a new version number and effective date, and record the version accepted by each account holder. Material changes will be communicated before they take effect.
